Yukselen Marble Software, its affiliates, and subsidiaries (collectively "Yukselen Marble", "we", "us", or "our") provide these Terms of Use applicable when you visit www.yukselenmarble.com and/or other websites owned or controlled by Yukselen Marble ("Site", "Sites"). By browsing any Site or using the services available on the Sites ("Services"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Use and our accompanying Privacy Policy (available on the website) and that you will comply with applicable laws and regulations. If you do not agree to these Terms of Use, you are not authorized to browse, access, or otherwise use the Sites or Services. Except as provided under the "Export Classifications" heading, these Terms of Use apply solely to the Sites and not to the purchase or use of our Products, which are governed by separate agreements.

Capitalized terms not defined in these Terms of Use shall have the meaning set forth in our Privacy Policy.

About the Information on These Sites

Information, data, text, graphics, images, audio recordings, audiovisual works, and other materials provided on the Sites by Yukselen Marble, its licensors, or you (collectively "Content") may contain technical inaccuracies or typographical errors. Yukselen Marble may remove, change, or update Content without notice. Yukselen Marble may also make improvements and/or changes to the Sites, Services, Products, and/or Programs described on the Sites at any time without notice to you.

Yukselen Marble assumes no responsibility for the accuracy of the Content provided by Yukselen Marble, and use of such Content is at your own risk. Yukselen Marble provides no assurance that any reported problems may be resolved with the use of any Content provided by Yukselen Marble.

User Submissions

Yukselen Marble does not want to receive confidential or proprietary Content from you through our Sites. Please note that any Content sent to Yukselen Marble or posted on the Sites will NOT be considered confidential. By sending Content to Yukselen Marble or posting Content on the Sites, you grant Yukselen Marble an unrestricted, irrevocable, perpetual, royalty-free, fully paid-up, transferable, and sublicensable right and license to use, reproduce, display, perform, modify, transmit, create derivative works from, distribute, and otherwise exploit that Content. You also agree that Yukselen Marble is free to use any ideas, concepts, know-how, or techniques that you send us for any purpose.

Community Rules

Like any community, ours works best when users follow a few simple rules. By accessing the Sites and/or using the Services, you agree to comply with these community rules ("Community Rules") and agree that:

  • You will not impersonate any person or entity or misrepresent or otherwise falsify your affiliation with a person or entity;

  • You will not cover, obscure, block, or otherwise interfere with any security feature on the Sites (e.g., a report abuse button);

  • You will not take any action that imposes or may impose (in our sole discretion) an unreasonable or disproportionately large load on our technical infrastructure;

  • You will not use spiders, robots, crawlers, data mining tools, or similar automated means to download or collect data from the Sites, except for internet search engines (e.g., Google) and non-commercial public archives (e.g., archive.org) that comply with our robots.txt file;

  • You will not use any automated device or software that enables the submission of automated posts on the Sites without human intervention or authorship.

Please notify us of inappropriate Content. If you find something that violates our Community Rules, please let us know so we can review it. We reserve the right, in our absolute discretion, to deny any person access to the Sites or any part of the Services without notice and to remove any Content that does not comply with these rules.

Furthermore, a link to a non-Yukselen Marble site does not mean that Yukselen Marble endorses or accepts any responsibility for the content or use of such site.

Disclaimer, Limitation of Liability, Indemnity

YUKSELEN MARBLE, ITS AFFILIATES, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS (COLLECTIVELY "YUKSELEN MARBLE PARTIES") DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, MERCHANTABILITY, NON-INFRINGEMENT OF THIRD-PARTY RIGHTS, AND FITNESS FOR A PARTICULAR PURPOSE, AND ALL WARRANTIES ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE REGARDING THE SITES, SERVICES, PRODUCTS, PROGRAMS, OR CONTENT. THE SITES, SERVICES, PRODUCTS, PROGRAMS, AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. YOU AGREE TO USE THE SITES, SERVICES, PRODUCTS, PROGRAMS, AND CONTENT ENTIRELY AT YOUR OWN RISK.

IN NO EVENT SHALL ANY OF THE YUKSELEN MARBLE PARTIES BE LIABLE FOR ANY DAMAGES (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM BUSINESS INTERRUPTION) ARISING FROM YOUR USE OR INABILITY TO USE THE SITES, SERVICES, PRODUCTS, PROGRAMS, OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF THE YUKSELEN MARBLE PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to defend, indemnify, and hold the Yukselen Marble Parties harmless from all third-party claims, damages, liabilities, and expenses (including attorneys' fees) arising from: (i) your use of and access to the Sites, Services, Products, Programs, and/or Content; (ii) your violation of any provision of these Terms of Use and/or our Privacy Policy; and/or (iii) your violation of any third-party right.

Trademarks

Yukselen Marble is a registered trademark of Yukselen Marble Software in the United States and a registered trademark or trademark of Yukselen Marble Software in other countries. All Yukselen Marble products and services listed on the Sites are or may be registered trademarks or trademarks of Yukselen Marble Software in the United States and/or other countries. You may not use any trademark appearing on the Sites without the prior consent of Yukselen Marble or the right holder.

Governing Law and Jurisdiction

These Terms of Use shall be interpreted and enforced solely in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of laws principles. You expressly agree that any legal or equitable action arising out of or directly or indirectly related to these Terms of Use or the Sites shall be brought only in a state or federal court in Boston, Massachusetts, USA.

Export Classifications

You expressly agree not to use, distribute, export, or re-export any Yukselen Marble Software (including Products) acquired or accessed through the Sites or Services to any country, person, entity, or end-user subject to U.S. export restrictions. You specifically agree not to export, re-export, or transfer any part of the Yukselen Marble Software to any country to which the U.S. has embargoed or restricted the export of goods or services (including but not limited to any country listed in U.S. Export Administration Regulations Country Group E-1).
